Minor differences that do not affect the product's operation, safety or main characteristics do not automatically constitute a defect.

Where a product differs materially from what was ordered, described or promised, the customer's statutory rights remain fully applicable.

4. Christmas, Self-Care, Wellness and Personal-Care Products

Products sold by Santas Warehouse may include Christmas gifts, seasonal decorations, lighting, electrical and non-electrical household or decorative products and, where offered, products intended for personal care, relaxation, comfort, wellness and support for a daily self-care routine.

Unless expressly stated otherwise for a specific product, the products are not intended for:

• making a medical diagnosis;
• treating or curing a disease;
• preventing a disease or medical condition;
• replacing medical care;
• replacing prescribed medication; or
• professional medical use.

A product will be offered as a medical device only where this is expressly stated for that product and the product may lawfully be marketed as such.

References to relaxation, comfort, care, appearance, a feeling of recovery or support for a routine must not be interpreted as a guarantee of a medical or therapeutic result.

6. Responsible and Safe Use

Before using a product, users must:

• read the complete instructions for use;
• follow all warnings and safety instructions;
• check whether the product is suitable for the intended use;
• check whether the product is visibly damaged, incomplete or unstable;
• take personal health circumstances into account; and
• observe the recommended duration and frequency of use.

A product must not be used for a purpose other than the purpose for which it was designed.

Do not use a product where:

• the product or packaging is visibly damaged;
• cables, connections, batteries or components are damaged;
• components are missing;
• the product becomes unusually hot;
• the product leaks, smokes, sparks or smells of burning;
• the product is unstable, broken or has loose or sharp components;
• safe use is not possible; or
• the instructions advise against use by the relevant person.

Stop using the product immediately in the event of pain, burning, irritation, swelling, dizziness, shortness of breath, overheating, an allergic reaction or other unexpected symptoms.

Seek medical advice from a doctor or another qualified healthcare professional for serious or persistent symptoms.

7. Health Conditions and Contraindications

Consult a doctor or another qualified healthcare professional before use where this is recommended in the product instructions or where the user has, for example:

• a pregnancy;
• a pacemaker or another implanted electronic device;
• epilepsy;
• a heart or vascular condition;
• a circulation problem;
• diabetes or reduced sensation;
• photosensitivity;
• use of medication that causes photosensitivity;
• an active skin condition;
• an open wound;
• inflammation;
• a recent operation;
• unexplained or severe pain; or
• another relevant medical condition.

Do not use products on damaged, burned, irritated or inflamed skin unless the manufacturer expressly states that such use is safe.

Product-specific instructions and warnings always take priority over general information on the website.

8. Skin Reactions, Allergies and Personal-Care Products

Products that come into direct contact with the skin, face, hair or other parts of the body must be used carefully and hygienically.

Electrical, heated, illuminated, battery-powered and rechargeable products must be used only in accordance with the supplied instructions.

Use only a suitable:

• adapter;
• charging cable;
• power supply;
• voltage;
• connection;
• battery;
• charger; and
• accessory.

Unless expressly stated otherwise, electrical products must not:

• be used in or near water;
• be operated with wet hands;
• be stored while wet;
• be left unattended while charging;
• be covered where ventilation is required;
• be opened, dismantled or modified;
• be repaired by the user or an unauthorised third party;
• be exposed to extreme heat, open flames or combustible materials;
• be overloaded or connected to an unsuitable power source;
• be used in a country or electrical installation with which they are not expressly compatible; or
• be used for longer than recommended.

To the fullest extent permitted by applicable law, Santas Warehouse is not responsible for damage demonstrably caused by technically unsuitable, incompatible or unauthorised adapters, batteries, chargers, cables, accessories or power supplies selected or used by the user.

The user must immediately stop using and, where safe to do so, disconnect a product that becomes unusually hot, swells, leaks, smokes, sparks, smells of burning, exposes wiring or behaves abnormally.

These use obligations do not reduce Santas Warehouse's duty to supply electrical products that are safe and conform to the agreement.

10. Non-Electrical, Decorative and Seasonal Products

Non-electrical products, decorations and seasonal items must be assembled, installed, mounted, placed, secured, maintained, cleaned and stored in accordance with the supplied instructions.

Users must observe any stated:

• age restriction;
• weight or load limit;
• indoor or outdoor designation;
• temperature or environmental restriction;
• mounting or fixing requirement;
• warning concerning sharp, small, loose, fragile or breakable components; and
• warning concerning children or pets.

Unless expressly designed for such conditions, non-electrical products must not:

• be placed near open flames, candles, heat sources or combustible materials;
• be exposed to water, excessive moisture or outdoor weather;
• be used for climbing, support, protection or another safety-critical purpose;
• come into contact with food;
• be placed where they may fall, tip over, obstruct an exit or cause a trip hazard; or
• be used as toys.

Packaging, cords, bags, small components and protective materials must be removed or stored safely and kept away from children and pets where choking, suffocation, ingestion, entanglement or injury could reasonably occur.

To the fullest extent permitted by applicable law, Santas Warehouse is not responsible for damage or injury demonstrably caused by incorrect assembly, installation, mounting, placement, loading, storage, maintenance or use contrary to clear instructions or warnings.

These use obligations do not reduce Santas Warehouse's duty to supply non-electrical products that are safe and conform to the agreement.

11. Product Liability and Limitation of Liability

Santas Warehouse is responsible for supplying products that conform to the agreement and the applicable product-safety requirements.

Nothing in this disclaimer excludes, restricts or limits:

• the statutory right to a conforming product;
• any statutory guarantee or mandatory consumer remedy;
• mandatory liability for a defective or unsafe product;
• liability for fraud, fraudulent misrepresentation or wilful misconduct;
• liability for deliberate recklessness or gross negligence where it cannot lawfully be limited;
• liability for death or personal injury where it cannot lawfully be excluded;
• product-safety, corrective-action, warning or recall obligations; or
• any other liability that applicable law does not permit Santas Warehouse to exclude or limit.

To the fullest extent permitted by applicable law, Santas Warehouse is not responsible for loss, damage, injury, fire, electrical damage, property damage, incompatibility, an allergic or sensitivity reaction or other consequences to the extent caused by:

• use contrary to the instructions, product page, labels or warnings;
• ignoring clear safety warnings;
• use for a purpose for which the product was not designed;
• incorrect assembly, installation, mounting, placement or operation;
• incorrect storage, cleaning or insufficient maintenance;
• repairs, dismantling or modifications carried out by the user or an unauthorised third party;
• use with unsuitable or incompatible components, liquids, adapters, batteries, chargers, cables or accessories;
• continued use while the product was visibly damaged, defective, unstable, overheating, leaking, smoking, sparking or otherwise behaving abnormally;
• failure to stop using the product promptly in the event of pain, irritation, an allergic reaction, overheating or malfunction;
• use by or around children or pets without the supervision required by the instructions;
• professional, commercial or unusually intensive use of a consumer product;
• normal wear and tear, normal battery degradation or depletion of consumable components;
• natural variations in colour, texture, finish or material that do not constitute a defect; or
• incorrect or incomplete information supplied by the user.

These exclusions apply only where the relevant act, omission or external circumstance actually caused or contributed to the loss and where the exclusion is lawful.

Subject to all non-excludable rights and liabilities and to the fullest extent permitted by applicable law:

• Santas Warehouse is not liable for indirect, incidental, special, exemplary, punitive or consequential loss or damage;
• Santas Warehouse is not liable for loss of profit, revenue, business, opportunity, goodwill, anticipated savings or data;
• Santas Warehouse is not liable for loss that was not reasonably foreseeable when the relevant agreement was formed;
• Santas Warehouse is not liable for damage caused by circumstances independent of Santas Warehouse after the product left its control and after any applicable transport risk had lawfully passed; and
• Santas Warehouse's total aggregate liability relating to a product, order or use of the website will not exceed the amount paid for the affected product or, if greater, the minimum amount of liability required by applicable law.

These limitations apply regardless of whether a claim is based on contract, tort, negligence, strict liability or another legal basis, but only to the maximum extent permitted in the user's jurisdiction.

If a country, state or province does not allow a particular exclusion, limitation or liability cap, the relevant provision applies only to the fullest extent permitted there. Nothing in this disclaimer shortens a statutory limitation period, reverses a statutory burden of proof or requires a consumer to waive a mandatory right.

Australian Customers

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

EU and EEA Customers

EU and EEA consumers retain all mandatory rights relating to conformity, product safety, defective products, remedies and unfair contract terms. No provision of this disclaimer is intended to exclude or restrict those rights.

12. Website Liability

Santas Warehouse makes reasonable efforts to keep the website secure, accessible and functioning correctly.

However, we cannot guarantee that:

• the website will be entirely free of faults or errors;

14. Address and Order Information

The customer is responsible for providing correct and complete order, contact and address details.

To the fullest extent permitted by applicable law, Santas Warehouse is not responsible for a delay or additional cost demonstrably caused by incorrect or incomplete information supplied by the customer.

This does not apply where the error was caused by Santas Warehouse or a party engaged by Santas Warehouse.

The customer must report an error in the order information as soon as possible at info@santas-warehouse.com.

15. Experiences, Reviews and User Content

Customer reviews and experiences are personal and do not guarantee that other users will experience the same result.

Santas Warehouse cannot guarantee the accuracy of every opinion, experience or statement published by a customer or another third party.

By supplying photographs, videos, reviews or other content to Santas Warehouse, the user confirms that the content does not infringe any third-party rights.

Santas Warehouse will use submitted content only with consent or where another valid legal basis exists.

Santas Warehouse may moderate or remove user content that is unlawful, misleading, fraudulent, abusive, irrelevant or infringes third-party rights, to the extent permitted by applicable law.
